Terms of Service
These terms explain what this website is, what it is not, and how it may be used. The most important point is the second one: the site is general information, not legal advice.
1. About these terms
These terms govern the use of the website mistysparrowcrest.com, operated by the operator of Misty Sparrow Crest (the operator; name on request), at 1-28-16 Noguchimotomachi, Beppu, Oita 874-0933, Japan. By using the site you accept them. Written notes bought from the operator are governed in addition by the Terms and Conditions of Engagement.
2. Information, not legal advice
- Everything on this site is general information about Japanese consumer contract law and e-commerce rules. It is not legal advice, a legal opinion or a substitute for advice from a lawyer (bengoshi).
- Using the site, writing to the operator or buying a written note does not create a lawyer-client relationship. The operator is not a law firm and does not act for anyone in a dispute, a negotiation or a proceeding.
- No result is promised. Whether a clause is valid, whether a seller must refund, or how a dispute ends depends on facts and on the law as applied by a court or a competent authority.
3. Accuracy and currency
- Pages describe public provisions, among them the Act on Specified Commercial Transactions, the Consumer Contract Act, the Civil Code and the Act on the Protection of Personal Information, in general terms and as understood on the date shown on the page.
- Laws are amended and article numbers change. Check the current official text, for example on the e-Gov law database, before relying on a provision.
- Errors can occur. If you notice one, please write to info@mistysparrowcrest.com so that it can be corrected.
4. Acceptable use
- You may read the site, use the contact form and write to the operator to ask about a written note.
- You may not submit false information, try to disrupt the site or its servers, send unrelated solicitations through the contact channels, or present text from this site as your own legal opinion.
- No account or registration is needed to use any part of the site.
5. Contact form and email
The contact form and the email address are for enquiries about the written notes and for questions about the site. Sending an enquiry does not commit either side to anything. How personal information is handled is explained in the Privacy Policy.
6. Intellectual property
- The text and structure of this website belong to the operator unless stated otherwise. You may quote short passages with a clear link back to the page.
- Photographs are illustrative stock images. The people shown are not staff, clients or authors of this site.
- The written notes delivered to a buyer are covered by the Terms and Conditions of Engagement.
7. Links to other sites
The site links to official sources such as the e-Gov law database or the Consumer Affairs Agency. Those sites are not controlled by the operator, and a link is not an endorsement or a sign of partnership.
8. Availability
The site is provided as available. It may be changed, paused for maintenance or taken offline without notice, and the operator does not promise uninterrupted access.
9. Limitation of liability
To the extent the law allows, the operator is not liable for loss arising from reliance on the general information on this site or from the site being unavailable. Nothing in these terms limits liability for intentional acts or gross negligence by the operator, and nothing takes away rights that a consumer has under the Consumer Contract Act or other mandatory law.
10. Examples and sample wording
The clause excerpts, sample observations and labelled panels on this site (for example the “Obligation Tab” and the sample renewal clause) are illustrations written for this website. They are not taken from a real store, a real client or a real case, and no real person or company is meant. Do not copy them into your own terms without having a lawyer check them.
11. Reporting errors
If you think a statement on this site is wrong or out of date, write to info@mistysparrowcrest.com and say which page and which sentence. A correction is made as soon as the point has been checked against the official text; the date at the top of a legal page changes when its wording does.
12. Changes
The operator may update these terms. The version published on this page, with the date at the top, applies from the date shown.
13. Governing law
These terms are governed by the laws of Japan. If a disagreement arises, the parties will first try to settle it by talking to one another; the courts with jurisdiction under Japanese law decide anything that cannot be settled that way.
