Ref. 001 — Consumer Contracts

Reading the terms a store publishes, the way a reader eventually will

General information on Japanese consumer contract law for online sellers: what a cancellation rule says, which items a shop page has to show, how a subscription should be described, and where a complaint usually starts. Written as information, not as legal advice.

Information, not legal advice

Misty Sparrow Crest publishes general information and sells short written notes. It is not a law firm, it does not give legal advice on an individual case, and it does not represent anyone before a court, a consumer centre or the other side of a dispute. No outcome is promised. When a dispute is already under way, or when a decision depends on exact facts, the right person to ask is a lawyer (bengoshi). Two public starting points in Japan are the Japan Legal Support Center (Houterasu) and the Consumer Hotline, dial 188.

Clause Index

§1

Cancellation & Returns

Online purchases in Japan have no general statutory cooling-off period. The return rule in Art. 15-3 of the Act on Specified Commercial Transactions applies unless the seller shows its own conditions; door-to-door and telephone sales follow separate rules.

§2

Display Obligations

Art. 11 of the same Act lists what an online seller shows on the sales page: price, payment and delivery terms, return conditions and the seller's identity. Some extras are only good practice.

§3

Subscription Renewal Terms

Since the 2022 amendments, the order-confirmation screen has to present the main conditions of a regular-purchase offer clearly (Art. 12-6). Renewal and stop procedures belong near the button, not only in the full terms.

§4

Delivery & Defect Handling

When goods arrive late, damaged or different from the page, the seller's responsibility for non-conformity is set by the Civil Code (konpon futekigo sekinin), and the Consumer Contract Act limits clauses that remove it.

Statutes are amended. Before relying on an article number, check the current text on the e-Gov law database run by the Japanese government.

What this site does

Most disputes over online terms do not begin with a dramatic breach. They begin with a clause copied from another store, a renewal date nobody checked, or a return window nobody wrote down clearly. The work here is close reading: setting what a store says next to what the public rules ask it to say, and next to how the store actually behaves.

Each note states an observation and the provision it concerns, and labels it as an obligation or a matter of practice. That is as far as it goes. Whether a provision applies to one particular store, or how a dispute would be decided, is a question for the reader's own lawyer.

Advisable

How an enquiry proceeds

  1. 01

A short description of the store, the service or the question arrives by email, by phone or through the form below.

  2. 02

Scope, price and timing are agreed in writing before any work begins. Nothing is charged for a first enquiry.

  3. 03

The written notes are returned by email with the provisions cited, together with a reminder of what they are not: information, not advice.

What these notes are not

Not legal advice

Notes describe public provisions in general terms. They do not assess a particular dispute.

No representation

No negotiation, no letters to the other side, no appearance in front of an authority.

No promised outcome

A clearer set of terms lowers the chance of a misunderstanding. It cannot guarantee that none arises.
